Menus and prices terms and conditions
Our menus do change throughout the growing season. Our catering coordinator will confirm the most current menu during the planning process. Due to changing market conditions, menu prices are subject to change. Menu prices & final menu selections will be confirmed no later than 8 weeks prior to your event.
1. Guest count:
- Our catering depends on the fact that any event we undertake is separately planned, purchased, and cooked. This means we must have rigorous terms regarding numbers.
- Our minimum order is 100 pax per event. If the function is less than 100 pax, the minimum per event will need to be $5000 to cater.
- All prices are quoted for a specific number of guests. When numbers drop, our overheads do not reduce proportionally, so our menu prices increase. Food and beverage minimum purchase: $100.00 USD per pax with a minimum of 50 pax per event.
- We require confirmation of numbers to be catered if we increase the guest list 30 days before an event.
- If the number of guests exceeds the number booked:
- An increase in numbers of up to 10 to 20 people can usually be accommodated, but no allowances can be made if numbers drop. If the number of guests attending exceeds the number booked, we will inform the client that we will not be responsible if the food is not enough.
- If the number of guests is less than the number booked:
- If the number of guests attending is less than the number booked, we will still charge the total number ordered.
- Children will be charged the full rate after 12 years old; kids aged 612 will be charged 50% of the price.
- d. Patravali will not be responsible for this and NO legal matters will be taken against Patravali Indian Cuisine or our employees.
- e. Sharing of plates will be charged per person per plate.
2. Payments and Deposits
- To secure a date in our calendars, we require a deposit of $1100.00 USD (taxes included), which is nonrefundable if the date moves or changes.
- For events booked less than 3 weeks prior to the date, the client must pay the total amount in full at the time of booking. No different terms for payment plans are valid unless given in writing by Patravali Indian Cuisine. The final guest count is required at the moment of booking.
- The Client shall be solely responsible for ensuring that payment is made in a timely manner and in accordance with the terms specified herein. Failure to make payment by the stipulated deadline may result in penalties or termination of the contract, as outlined in the Early Termination clause.
- Upon receipt of payment, Patravali Indian Catering shall provide the Client with an invoice detailing the services rendered and the corresponding payment received. The Client shall retain a copy of the invoice for their records.
- In the event of any dispute regarding payment or invoicing, both parties agree to engage in good-faith negotiations to resolve the issue amicably. Any disputes unresolved through negotiation shall be subject to resolution in accordance with the dispute resolution provisions of this contract.
- All applicable taxes and fees related to the Services provided under this contract shall be the responsibility of the Client and shall be included in the total amount payable to Patravali Indian Catering.
- The Client acknowledges that payment for the Services constitutes acceptance and satisfaction of all financial obligations under this contract, except as otherwise expressly provided herein.
- Payments may be made via bank transfer, cash, or debit card only. Credit card payments are not accepted. The Client shall ensure that payments are made in the currency specified in the contract, either in Mexican pesos or dollars. In the case of payments made in Mexican pesos, the exchange rate applied shall be in accordance with the official exchange rate at the time of payment.
3. Additional Services Rental fees & Coordination:
- The client agrees to pay for any additional services requested by the client not included in the contract. Any extra service requests must be made in writing.
- The caterer is only a food provider as per this contract but can assist with the rental of equipment, hiring of service staff, rental of kitchen space, or satellite kitchen facility. Based on the client’s menu selections, a list of required equipment will be provided to the event venue/hotel/banquet facility. The client must ensure the event venue provides the equipment to the Caterer. Payment for any extra hiring or renting of equipment will be the responsibility of the client.
- All equipment and setup are not included; please contact us for an adjustment to your query.
- We do not have waiters for serving, but we can share the contact of a reliable serving company, in case the venue does not provide it
4. Force majeure:
- Patravali Indian Catering shall not be liable for any failure to perform its obligations under this contract if such failure is due to events beyond its reasonable control, including but not limited to riots, strikes, pandemics (such as COVID or its variants), weather conditions, floods, road accidents, government actions, or any other unforeseeable circumstances ("Force Majeure Events").
- During a Force Majeure Event, both parties shall be excused from their respective obligations under this contract. Patravali Indian Catering will promptly notify the Client of the Force Majeure Event and its impact on the contract's performance.
- If a Force Majeure Event continues through the event or for more, or if the event is delayed due to the Force Majeure Event, either party may terminate this contract without liability. Neither party shall be liable for damages or penalties resulting from such termination.
- This clause does not relieve the Client of its obligation to pay for services rendered before the occurrence of a Force Majeure Event.
5. Change of event date or venue:
- a. Caterer will apply the entire balance of the client’s deposits and prepayments, towards another event, subject to Caterer’s availability. All costs are subject to change.
6. Prices:
- a. Prices stated are subject to change according to the market price of products and with a final guaranteed number of guests.
- b. The caterer will inform the client of market price changes no later than 30 days before the event.
- The client will have the option of revising products and services to reduce costs prior to payment as described in the payment term. Upon payment, the final price is fixed and may only change due to a change in the number of guests or mutually agreed upon changes in the services and/or menu provided.
7. Cancellation:
- If the client needs to cancel the event for any reason, such as acts of God, riots, strikes, pandemics, weather conditions, or any other act beyond the client’s control, the client must provide written notice to the Caterer and shall not be liable for any cancellation charges.
- b. Client understands that upon entering into the contract, the Caterer is committing time and resources to this event, and thus cancellation would result in lost income and lost business opportunities in an amount hard to precisely calculate.
- Therefore, the following cancellation limitations will apply. If the client requests cancellation of the contract, it will be charged completely depending on the caterer’s accordance with the days remaining to the event. If client cancellation occurs within 15 days in advance of the event date, the caterer shall be entitled to 100% of the estimated total cost. The client’s deposit will be credited against the cancellation fees owed. Any balance will be payable upon the notice of cancellation.
8. Food policy:
- Quantity: The caterer will prepare between 5% overage based on the final number of guests. Part of this overage includes food for the staff and/or service providers.
- Leftovers: It is not our policy to leave leftover food, as it must be discarded after two hours of being out due to health and government policies.
- c. We reserve the right to discard any leftover food. If you (the client) or any of your guests request to take any of the remaining uneaten food items, it means we are not responsible for any harm.
- We accept no liability for any food supplied to the client by another caterer or food products suppliers arranged by the client or other sources. We do not cater alongside other caterers or Indian food from the resort.
- e. We do not sell ingredients, Indian ingredients, or any type of Indian products.
9. Dietary requirements and allergies:
- Patravali Indian Cuisine will try to provide suitable adaptations to the client's menu for any guests with special dietary requirements or allergies. We cannot, however, take responsibility for any guests unless advised in advance.
- For Jain/Swaminarayan preparations, please notify us about the ingredients not required and the number of persons.
- c. Alcoholic beverages: Patravali Indian cuisine Caterers will never supply any form of alcoholic beverages for any kind of event.
10. Time:
- The (Client) must make a written request for the Services on each occasion specifying the modalities of the Services required (hereinafter referred to as the "Modalities" or the "Modalities"), the date, time, and location in which they must be carried out, and any other relevant details. Patravali Indian Catering must respond to the (Client) within no more than 72 hours from the moment the corresponding request is sent, providing a quote for the Services indicating the total amount to be paid and specifying each concept taken into account to obtain said total (the "Total Price").
- The event attention time must correspond to the wedding planning timeline. If this exceeds the planned duration, there will be a charge of USD 150 + TAXES for every 30 minutes of excess time.
- a. Client will be billed for additional staff hours for any time extension beyond the prior agreed-upon time.
11. Client’s responsibility:
- The client is responsible for ensuring the accuracy of all information provided to the caterer and for communicating any changes or updates on time.
- The client agrees to provide access to the event venue and necessary facilities for the caterer to perform its services.
- The client is responsible for any damage to the venue or equipment caused by the client or their guests.
- The client must conduct the event in an orderly manner and full compliance with all applicable laws, ordinances, regulations, and facility contracts.
- Patravali Indian Catering is only a food provider as per this contract but can assist the client with the rental of equipment, hiring of service staff, rental of kitchen space, or satellite kitchen facility. Based on the Client menu selections, a list of equipment required will be provided to the event venue/hotel/banquet facility by Caterer. The Client must make sure the event venue provides the equipment to the Caterer. Payment for any extra hiring or renting of equipment will be the responsibility of the Client.
12. Damage:
- The caterer assumes no responsibility for any damage or loss of merchandise, equipment, furniture, clothing, or other valuables before, during, or after the event. The caterer will do everything possible to ensure that all the client’s supplies, rentals, and equipment are cared for and maintained in good working order without damage. When providing the location for the event, the client understands that accidents, breakage, and/or damage may occur. The caterer will not be liable for any damage or loss unless caused by the willful negligent actions or conduct of the Caterer or its employees.
16. Food Tasting
- Food tasting is done only on selected available days and times. Please contact us for details. We charge $85.00 USD for the couple and $45.00 USD per person plus tax for extra guests, this is not refundable, as it is at the Restaurant Patravali Indian Cuisine, and will be charged there
14. VAT payments:
- Please note that a 16% tax will be added to all of the products.
15. Transportation charges:
- a. All transportation is not included. This will be adjusted to the distance from our banquet kitchen to the venue.
17. Agreement and payment information:
- Events will not proceed without a returned signed catering agreement, banquet event order, and fulfilled payment information requirements. A wire transfer must be on file and will be used to process all payments. Patravali Indian Cuisine does not directly bill any social events, and all payments must be received according to the signed contract clauses before the scheduled events.
